The approach method used in this research is empirical juridical with a statutory approach and a factual approach and descriptive analytical specifications. The material of this research is the implementation of the principle of prudence in mortgage financing at Bank BRI Purwokerto Branch. Data analysis used a qualitative approach. The results of the study conclude that the application of the precautionary principle is carried out by Bank BRI by conducting an analysis that is outlined in the form of an application analysis with the precautionary principle by carefully examining the files and customer data obtained. Prospective customers must meet a number of requirements for applying for a BRI mortgage that has been determined and a list form has been provided. Credit analysis is carried out by the analyst officer in order to provide an overview of the applicant's condition, the applicant's financial condition and the applicant's ability to pay as a consideration for the bank. Mortgage Credit Approval can be implemented after the applicant agrees and has signed the Credit Granting Principle Approval Letter (SP3K). Illnesses and work accidents experienced by a worker not only have an impact on reducing the worker's personal health level, but will also have an economic impact on the family and society, considering that workers are the source of the family's economy, reduced worker productivity will result in a decrease or loss of family income which ultimately will have an impact on society at large. The approach method used in this research is a non-doctrinaire legal research method, namely understanding and researching law in its social context because the focus is more concerned with the issue of how law works in society. The research specifications used are descriptive analysis, namely describing existing phenomena carried out in accordance with research methods. In this research, the data sources used are primary and secondary data. Reconstruction of Occupational Safety and Health (K3) Regulations Based on Justice Values ​​was analyzed using the Utiliarianism Theory of Abû Zahrar and Jeremy Bentham as the grand theory, the Legal Effectiveness theory as the middle theory as well as the legal reform theory and Bird and Loftus' theory as the applied theory. The basic premise of the bird and loftus theory is, "weaknesses in management functions, supervisory leadership, work standards, performance standards, error correction are very influential in the occurrence of work accidents. In the procurement of credit in banks, several problems can be found, one of them is the case of fictitious credit that has dragged Notary / PPAT. Notary / PPAT as an authorized public official to make authentic deeds where in the administration of credit at the Bank, the Notary makes a Deed of Credit Agreement and / or Power of Attorney Encumbering Mortgage Rights (SKMHT) and the Land Deed Official (PPAT) makes a Deed of Encumbrance of Mortgage Rights (APHT). The fundamental issue that will be discussed by the author is how the Notary / PPAT's responsibility for fictitious credit at the Bank. The research method used is normative research with references sourced from books, literature, laws and regulations, journals, and internet. The result of the author's research is that the cause of fictitious credit cases are caused by several factors, and the author's focus is on the factor of falsification and misuse of identity by the debtor and internal parties from the bank by using data from other customers to bind credit and issuing covernotes by Notary / PPAT that are different from the facts that occur.
