TINJAUAN YURIDIS PRAKTIK BRUSHING DALAM LINGKUP E-COMMERCE BERDASARKAN PERSPEKTIF UNDANG-UNDANG PERLINDUNGAN KONSUMEN DAN HUKUM TELEMATIKA DI INDONESIA

Abstrak

This study aims to analyze the legal protection for consumers against brushing practices in the form of false positive reviews and fictitious orders on E-commerce platforms for a product of goods and/or services in the perspective of the Consumer Protection Law (UUPK) and the Electronic Information and Transaction Law (UU ITE). The practice of brushing is considered to violate consumer rights, damage healthy business competition, and mislead public information. The research method used is normative juridical with a literature study approach. Sources of legal materials include laws and regulations, scientific journals, and other legal literature which are analyzed to identify the void of norms related to the issue of brushing. The results showed that there is a vacuum of norms and regulations that are not adequate and clear to deal with the practice of brushing effectively. Thus, regulatory reforms, education, firm policies from E-commerce platforms and the government are needed to create optimal legal protection and a fair digital ecosystem.
