Abstract

The realization of a safe, orderly, and smooth traffic system is highly dependent on the effectiveness of fulfilling transportation requirements. As a regional agency, the Transportation Agency carries out the functions of supervision, regulation, and enforcement in the field of road transportation in accordance with the attributive authority mandated by laws and regulations. However, in practice, the exercise of this authority shows juridical dynamics that are inseparable from normative and empirical factors. This study aims to analyze the juridical dynamics of the attributive authority of the Gunungsitoli City Transportation Office in enforcing road transportation order and examine various problems faced at the implementation level. This study uses an empirical juridical method supported by regulations and conceptualization where data is collected through literature studies and field interviews. The results of the study show that the attributive authority of the Transportation Agency has been normatively regulated, but in its implementation the implementation of tasks is still hampered by a number of challenges, including the lack of availability of resources, lack of community compliance, and lack of optimal coordination between agencies. This dynamic has implications for the non-optimal enforcement of road transportation order in Gunungsitoli City. Therefore, it is necessary to strengthen institutional capacity, increase public legal sensitivity, and synergy between agencies to create optimal legal compliance
