Abstract
This dissertation research concludes two (2) conclusions. First, implementation fulfillment of the right to primary and secondary education in border areas in the province West Kalimantan from 2005 to 2017 has been gradually fulfilled by the government
center and area. The conformity factor has been endeavored to be carried out according to the provisions or international standards as in the Covenant on Economic, Social and Cultural Rights. However, regulations, policies and programs that have been made are not yet harmonious at the vertical level and horizontally thereby slowing down the process. Second, technical factors and geographical factors become the main determining factor in the low fulfillment of the right to primary and secondary education. These factors gave rise to the status quo "areas that do not want schools" in the border area in five districts, especially in the Kapuas Hulu district. The two determining factors has systematically reduced the implementation of laws, policies, programs and funding primary and secondary education both at the vertical and horizontal levels.
