KAJIAN PENATAAN PENGELOLAAN HUTAN: SEBUAH TEROBOSAN DALAM MENATA KEMBALI KONSEP HUTAN BERBASIS SUSTAINABLE FOREST MANAGEMENT

Abstract

This article contains the objective of answering the main issues regarding the form of change in forest governance after the issuance of the “Cipta Kerja” (UUCK) and analyzing the obstacles faced in forest management in order to realize the concept of Sustainable Forest Management (SFM) or known as “Pengelolaan Hutan Lestari” (PHL) or “Hutan Berkelanjutan” (PHB). The research method used is normative legal research. While the approach used is the statutory approach and the conceptual approach. Research results include; The UUCK and its derivative regulations amend several articles in the Forestry Law, including modifications to the scale of forest areas that are determined, the authority of the DPR to give approval for the conversion of forest areas, and changes to forest functions that lead to the exploitation of protected forest areas. Changes in the provisions of the Forestry Law certainly have an impact on forests. This is in line with the goal of the Indonesian Government to initiate the forestry sector into a UUCK, which is to facilitate the flow of permits to increase investment in Indonesia. The problem of human-caused exploitation of forest resources is still a major obstacle that must be addressed, bearing in mind that forests have a large share of impacts on aspects of life, environment and development.
